Legal Agreement for Participating in a Holidaze Ski Tours Ski Package

This agreement contains the terms and conditons by which Holidaze (A division of Five Star, Inc.) 810 Belmar Plaza, Belmar, NJ 07719 ("Operator") in consideration for a Participant's payment, agrees to provide these travel tours. READ THIS AGREEMENT CAREFULLY BEFORE SENDING ANY MONEY.
TOUR PRICES: All land costs for programs included in this offering are guaranteed in US dollars.
PAYMENT: A deposit of $100.00 per person and a signed Operator Participant is required within 7 days to secure reservations. If payment is made by credit card: (i) a signed, fully completed credit card voucher for full payment, with proper authorization, must be received to secure reservations and (ii) Participant(s) waive any charge back rights. In the event of a dispute, requests for refunds must be made under the procedure described below under Cancellations and Refund Policy . Any other persons or entity (including a travel agent) who receives monies from Participant(s) does so strictly as an agent for the Participant(s). The Operator disclaims liability for such monies until received by Operator's office and confirmations is issued by Operator. Tender of a deposit constitutes acceptance of these terms and conditions. Complete payment must be received no later then 60 days prior to departure. Make checks payable to Holidaze or your travel agent who must in turn make his check payable to Holidaze. After deposit, all revisions with the exception of adding insurance are subject to a $25.00 charge. No changes will be accepted within three weeks of departure. Changes that affect inventory utilization (e.g. date change, hotel change, etc.) will be considered a cancellation.
CHANGES: A $25.00 handling fee will be charged for any change in reservation that is requested after the original booking has been made and processed.
CANCELLATION CONDITIONS:Certain commitments for air and land arrangements have been, or are being made on your behalf in connection with the tour described herein. Naturally, along with these commitments comes a certain responsibility on your part that will necessitate certain cancellation penalties in the event you cancel your tour arrangements prior to the departure date. All notices of cancellations must be received in writing at our office in order to be considered valid. The amount of cancellation charges, if any, will be determined by the following schedule in accordance with the date such notice is received.
For cancellations received:
Up to 60 days prior to departure: $25.00; 59 to 46 days prior to departure: $75.00; 45 to 31 days prior to departure: $125.00*; 30 to 09 days prior to departure: $175.00*; 08 days or less prior to departure: $250.00*
*Plus any further charges assessed by hotels, suppliers and airlines.
No shows are non-refundable. Charges indicated are per person.
DOCUMENTS: Documents will be mailed to your Travel Agent approximately 14 days prior to departure. For bookings made or final payments received within 30 days of departure you must include an additional $15.00 with payment and documents will be sent via overnight delivery. Documents are sent by First Class Mail and become the property of the participant the moment they are accepted by the U.S.P.S. If desired by the participant, Holidaze will send documents by Federal Express upon receipt of $15.00 from or on behalf of the participant.
LAND TRANSPORTATION: As specified in the itinerary, Ground transportation will be provided by deluxe motor coaches, 2nd class rail, or rental cars.
AIR TRANSPORTATION: Unless otherwise noted, all air transportation will be on the basis of economy class.
HOTELS: Accommodations will be as listed except, in the event of overbooking however, the Tour Operator reserves the right to substitute hotels of a similar catagory.
MEALS: Sancks and meals are served diring some flights. See country pages for explanation of meal codes for your particular tour.
TRANSFERS AND SIGHTSEEING: The services of competent local guides and hosts will be provided on all coach transfers, optional tours and at hospitality desks where indicated.
TIPPING: Basic handling charges to hotel staff, porters and chambermaids are included. However, it is customary to tip bartenders, bus drivers and guides, waiters and waitresses at the end of your stay.
NOT INCLUDED: Tour prices do not include items not specified above. Passports are required and are the passengers responsibility. Also, not included are airport taxes, passenger facilitiy charges, tips, laundry, mineral water, excess baggage and items of a purely professional nature. Visas are not required for any of the destinations herein.
INCLUDED CARS FOR TRANSFERS: On certain tour programs, self-drive cars are provided for the transfers. Tour programs that feature a rental car include unlimited mileage for the week. The rates quoted do not include value added taxes (VAT or collision damage waiver (CDW). Also not included are ski racks. VAT/CDW as well as ski racks can be ordered prior to your departure.
REFUNDS: Since all tours are on the basis of inclusive arrangements, no refunds can be made, considered or given for any absense from the tour or any unused services or meals once the tour has commenced and is EN ROUTE unless arrangements have been made at the time of booking. Any and all claims for refunds are to be made at the booking office, as no agents, representatives, guides or any other persons, are authorized to make or promise refunds, or to make any change or alteration of the offical conditions and regulations. No claims can be considered if not made within 60 days from completion of the tour. No claim can be considered if it is not accompanied by a completed service adjustment coupon or written authorization from outr representatives and/or hotel. Telephone requests for refunds will not be considered and are not valid. All information and details on resorts, hotels, ski areas and local prices of lifts, etc. were supplied by tourist offices, hotels, and the ski resorts. Prices are subject to changs and not all facilities may be in operation at the time of your vacation. If you are in doubt, please ask.
RESPONSIBILITY AND LIABILITY Holidaze Ski Tours, a division of Five Star Corporation, 810 Belmar Plaza, Belmar, NJ 07719 in operating these land arrangements is responsible to the participants for supplying the services and accommodations offered to the participants, as stated in the offering. Holidaze as tour operator, disclaims all liability for loss or damage or injury sustained in connection with services and accommodations provided by railroads, bus operators, local sightseeing companies, tour operators. steamship companies, airlines, hotels and lodging facilities, all operating under the laws of the country in which their services are rendered. Holidaze also retains the right to decline to accept any tour participant at any time. Tour participants engaging in sports activities do so at their own risk. Tour participants engaging in these, or any other activities, by the act of joining the tour relinquish any and all rights whatsoever to make claims for damages for injuries that may be sustained while engaging in these activities. The right to alter any land arrangements is reserved. Airlines sheduled to be used are stated in operator's current brochure. The airlines cannot be held responsible for any act, omission or event during the time passengers are not on board their aircraft. Airline tickets, when issued, constitute the sole contract between the carrier and the passenger. The carriers concerened are not, in any event, responsible for any act omission or event occurring during the time the passengers are not on their plane, vessels or any other conveyances. Holidaze is not responsible for typographical errors.
